Terms and Conditions
1.a Herein these terms and conditions David P. Gossett Inc, dba “Ariston Speed Shop” shall be referred to as “Ariston” or the “Shop” thereby the entity performing the work, services, and/or consulting for Ariston. Herein the “Client”, which shall be any person(s) asking for work the be performed, or otherwise, shall imply that work be performed, shall be referred to as the Client. Client is also referred to as any agent acting upon the behalf of the client.
1.b The client shall be bound to and comply with these terms and conditions upon any one or combination of the following actions, but not limited to the following actions, but when the intent is to have Ariston perform work for client, such as when client request that work be performed, pays a deposit, pays for parts and/or labor, or has an agent acting on behalf of the client request work be performed. As soon as the client requests work to be performed, they knowingly accept Ariston’s terms and condition in full.
1.c There are no exceptions, modifications, additions to, changes, ect to the terms and conditions by the client, unless it is agreed to prior to any services rendered, and is in written form, signed and dated by client and Ariston. Any modification to this agreement made after work has begun will constitute a breach of contract and client will be responsible for all costs due.wih
Scope of Work
2. a Directions for the services/work will be deemed acceptable and contractual based on any verbal, written, sketches, drawings, text, email, voice mail, or any other communication, provided to Ariston by client. Client is responsible to provide sufficient information so Ariston may proceed with project without untimely delays.
2.b If client does not provide specific details, instructions, designs, or other so Ariston may complete work, then client accepts Ariston’s interpretation of clients desires and will proceed as it sees appropriate to meet the project goals.
2.c The work will progress at a reasonable pace, agreed to by client and Ariston. Client agrees to hold harmless Ariston for any and all delays in securing parts and materials, or subcontractors hired, or required to complete the projects.
2.d Ariston reserves the right to terminate work on any given project. Owner may terminate the project at any time. Upon termination all payments due shall be paid in full prior to project leaving the Ariston premises. Ariston reserves the right to retain any materials, parts, items that are not paid for in full.
2.e Ariston reserves the right to charge storage fees on projects stored on premises, if said projects have not had any work performed on them for a period of 14 calendar days, unless agreed upon by Ariston. Storage Fees will be assessed at $100/day. Said fees will be paid in full prior to any work being released.
Warranties and Liability
3.a Client agrees that all claims will be limited to Ariston and further agrees to indemnify and hold harmless all owners and employees of Ariston, David P. Gossett personally, including all personal interests of David. P. Gossett. Claims will be limited to Ariston and parent Corporation David P. Gossett Inc.
3.b Any and all warranties issued or implied shall be 30 days from the time the work is completed, and/or invoiced by Ariston. No acceptions. Client agrees to indemnify and hold harmless all owners and employees of Ariston, from and against all liabilities, legal fees, damages, losses costs and other expenses in relation to any claims or actions brought against Ariston.
3.b All claims for warranty of defective parts, materials, ect will be the responsibility of Client to pursue with the manufacturer of said part, Ariston will be held harmless for all items not specifically manufactured by Ariston. It is the client’s responsibility to make claims with the original manufacturer of said parts and materials. Ariston will assist for basic shop rate based on time spent.
3.c All claims for faulty parts, materials, ect. shall lie with the respective manufacturer of said parts or materials. Client has agreed to accept parts and materials upon payment for said items, and is up to client to verify parts and materials prior to payment. This shall be true of any parts or materials purchased by Ariston for the benefit of client, or that are provided by the client.
3.d Ariston shall warranty all parts manufactured or fabricated by Ariston. This warranty shall be limited to either a replacement part being fabricated to replaced defective item, the defective item being repaired, or a suitable commercially made part being supplied to client. Any and all claims by client must allow Ariston reasonable time to cure, product/project must be returned to Ariston’s premises to be remedied. Ariston will be allowed a reasonable time frame to remedy any and all such claims. Failure to allow Ariston to remedy a warranty item, make appropriate remedies, or otherwise examine the issue at Ariston facilities, will result in Client forfeiting any rights to warranty claims and thus Client assumes all responsibility to remedy such claim.
3. e Any modification, changes, or otherwise altering a part, project, or any item produced by Ariston will void all warranties and/or claims.
Invoice and Payments
4.a Ariston performs work on a “time and materials” basis based on a base rate of $70/hr, unless otherwise agreed to prior to the work being performed and agreed upon in writing by Ariston. Any “budget” provided to the Client by Ariston is intended to “guide” the client on their decisions and directions to Ariston for the project, it is not a commitment by Ariston to perform any work, secure parts, or secure subcontractor for a given price.
4.b Ariston shall bill client on a bi-weekly basis for all work and materials. Client agrees to provide funds within 5 days from invoice date. Client thereby agrees to billing procedures upon the first payment made by client.
4.c By making payment on an invoice, client agrees and accepts the work and materials provided by that respective invoice. It is the client responsibility to verify that all work and materials are correct and/or acceptable.
4.d Ariston reserves the right to stop work on clients project if payments are not received on a timely manner.
Restoration and Custom Projects
5.a Ariston shall not be held responsible for any loss or value, any claims of damages due to the custom nature of the industry, damage to existing parts or projects, or otherwise arising out of the scope of work. It is the nature of highly customized, or restoration work,
5. b The common projects in the scope of work at Ariston, is to produce projects that are meant for show purposes, and are not intended to be equal to, or in anyway replace the safety standards available in the current vehicles. Client is fully aware that these vehicles may not contain such items as air bags, side air bags, crash safe cages, roll bars, seat belts, or otherwise as present in current vehicles. Thier use is intended as show and parade vehicles.
5. c Client shall be responsible to at all times maintain insurance on the project to cover any and all damages, related to theft, loss, fire, water damage, natural hazards or otherwise. Ariston is not responsible to any damages to any vehicle on the premises.
